CONFERENCE OBJECTIVE The Conference focuses on the accession of the Kingdom of the Netherlands to the Cape Town Convention in 2010. While the treaty has entered into force in the Dutch Caribbean (e.g. Aruba), it is not yet applicable in the Netherlands in Europe. However, the convention already applies in Bonaire which is a ‘special city’ of the Netherlands in Europe while it is situated in the Caribbean. This unique situation allows foreign and Dutch parties to an international lease transaction to register the aircraft in the jurisdiction that suits them best. For example, overseas owners and financiers of aircraft can “choose” the Aruba flag. Their aircraft get the nationality registration prefix ‘P4 ’ of Aruba. This option ensures that they can enforce their rights under the treaty. But also new or existing (Dutch) airlines that “prefer” the Dutch flag may benefit from the Cape Town Convention. They can structure their leases through Bonaire (i.e. the Netherlands), while their aircraft keep or get the Dutch nationality registration prefix ‘PH ’. Moreover, they may profit from the tax-treaties which the Netherlands concluded with more than 90 states. Thus, the Cape Town Convention boosts several fiscal and legal scenarios that facilitate the (off-shore) registration, lease and finance of modern and safe aircraft. It reduces their costs in the Netherlands, Dutch Caribbean and in other countries.
WHO SHOULD ATTEND The Conference is intended for corporate and private aircraft owners, banks, other financial institutions, lessors, airlines, trust companies and their (in-house) tax lawyers, legal counsel, civil law notaries, accountants and all with a fiscal and legal interest in international aviation financing and leasing. It is the first major international aviation finance symposium organised in the Netherlands. The particular goal of the Conference is to provide the delegates with topical and specialised practical knowledge. More specifically the Conference - assesses one year of experience with the Cape Town Convention in the Kingdom of the Netherlands; - addresses the latest fiscal and legal developments in this respect; - introduces a swift, simple and cheap alternative for the expensive creation and registration of mortgages in aircraft; - clarifies that the Cape Town Convention protects the secured rights of (Dutch) airlines to purchase or lease an aircraft; - aims to provide an solution to the existing global aircraft de-registration and re-registration problems; - stresses the aviation finance friendly Court systems in the Netherlands and Dutch Caribbean; - emphasises the valued airworthiness and safety-oversight standards of the Netherlands and Dutch Caribbean; - acknowledges the need and availability of trust services in the Netherlands and Dutch Caribbean; - signals other pertinent matters that recently arose in the international aviation tax, finance and lease practice.
